3. Bookings and Reservations

3.1 Making a Booking

When you make a booking through our website or directly with our travel consultants, you are offering to purchase the services specified under these Terms and Conditions. A contract is formed when we accept your booking and send you a confirmation.

3.2 Booking Requirements

By making a booking, you confirm that:

  • You are at least 18 years of age
  • You have the legal authority to enter into this agreement
  • The information you provide is accurate and complete
  • You will be financially responsible for all charges, fees, and costs arising from your booking

3.3 Payment

To confirm your booking, a deposit or full payment is required as specified at the time of booking. The balance of the payment must be received by the due date specified in your booking confirmation. If payment is not received by the due date, we reserve the right to cancel your booking and apply cancellation charges.

We accept various payment methods as indicated on our website or at the time of booking. All prices are quoted in the specified currency and include applicable taxes unless otherwise stated.

3.4 Travel Documentation

It is your responsibility to ensure that you have valid travel documentation, including passports, visas, and health requirements for your destination. Your passport must be valid for at least six months beyond your planned return date. We are not responsible for any issues arising from inadequate travel documentation.

4. Travel Services

4.1 Our Role as an Agent

For many travel services, Gentle Balance acts as an agent for Travel Suppliers. While we select our Travel Suppliers with care, we do not control them and are not responsible for their actions or omissions. The contract for the provision of travel services is between you and the Travel Supplier.

4.2 Service Descriptions

We make every effort to ensure that the descriptions of services on our website are accurate and up-to-date. However, Travel Suppliers may change their facilities or services without notice. We are not responsible for any inaccuracies in information which is not under our control.

4.3 Special Requests

We will pass on any special requests you have (such as dietary requirements or room preferences) to the relevant Travel Supplier, but we cannot guarantee that these requests will be met. The fulfillment of special requests is outside our control.

4.4 Travel Insurance

We strongly recommend that you purchase comprehensive travel insurance to protect against unforeseen circumstances. It is your responsibility to ensure you have adequate insurance coverage for your specific needs.

5. Changes and Cancellations

5.1 Changes by You

If you wish to change any part of your booking after the confirmation has been issued, we will do our best to assist, but we cannot guarantee that changes will be possible. Any change may require cancellation and rebooking, which may be subject to cancellation charges and availability of alternative arrangements.

All requests for changes must be made in writing to us and are subject to our approval and the Travel Supplier's terms and conditions.

5.2 Cancellation by You

If you need to cancel your booking, you must notify us in writing as soon as possible. Cancellation charges will apply based on when we receive your written notification. The cancellation policy for your specific booking will be detailed in your booking confirmation.

5.3 Changes by Us or Travel Suppliers

Occasionally, it may be necessary to make changes to your travel arrangements due to circumstances beyond our control or the control of our Travel Suppliers. We reserve the right to modify or cancel any booking in such circumstances.

If a significant change or cancellation occurs, we will inform you as soon as reasonably possible. We will endeavor to offer you alternative arrangements of equivalent or similar standard, or a refund of all monies paid for the affected portion of your trip.

5.4 Force Majeure

We will not be liable for any failure to perform or delay in performance of our obligations under these Terms due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government action, strikes, natural disasters, disease outbreaks, or technical failures.

6. Liability Limitations

6.1 Our Liability

We will exercise reasonable care and skill in performing our obligations under these Terms. However, to the maximum extent permitted by law, we limit our liability to you for any claims, losses, damages, costs, or expenses you may incur in connection with our services to:

  • The re-supply of the services; or
  • The payment of the cost of having the services supplied again; or
  • The refund of the amount you paid for the affected services.

6.2 Exclusions of Liability

We are not liable for:

  • Any act, omission, or default by Travel Suppliers or other third parties
  • Any loss, damage, injury, illness, death, or expense due to circumstances beyond our reasonable control
  • Any loss of enjoyment or disappointment due to circumstances outside our control
  • Any indirect or consequential losses
  • Any loss or damage to personal belongings during your travel
  • Any information provided by third parties

6.3 Consumer Rights

Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any rights that you may have under applicable consumer protection laws that cannot be excluded, restricted, or modified by agreement.

7. Your Responsibilities

7.1 Travel Behavior

You agree to:

  • Comply with all applicable laws, regulations, and customs of all countries visited
  • Respect the customs, religions, and cultural practices of the places you visit
  • Behave in a manner that does not disrupt the enjoyment of other travelers or cause offense to locals
  • Comply with the reasonable instructions of tour leaders, guides, and Travel Suppliers

If, in our opinion or that of our Travel Suppliers, your behavior is causing or likely to cause danger, distress, or annoyance to others, we reserve the right to terminate your travel arrangements without notice or liability. In such cases, you will be responsible for your own repatriation and related costs, and you will not be entitled to any refund.

7.2 Health and Fitness

You are responsible for ensuring that you are physically and mentally fit for travel. Our tours may involve activities that require a certain level of physical fitness. We recommend that you consult a doctor if you have any concerns about your ability to participate in the planned activities.

You must inform us at the time of booking of any medical or physical condition that may affect your participation in the tour or require special accommodation.

7.3 Travel Risks

Travel involves inherent risks, and you acknowledge that you are traveling at your own risk. You are responsible for familiarizing yourself with the risks involved in your chosen destination and activities, and for taking appropriate precautions.

We recommend that you check travel advisories issued by your government and obtain appropriate travel insurance before departing.

8. Privacy and Data Protection

We collect and process your personal information in accordance with our Privacy Policy, which is available on our website. By using our services, you consent to our collection and use of your personal information as described in our Privacy Policy.

9. Complaints

If you have a complaint during your trip, you must promptly notify the relevant Travel Supplier and our representative (if applicable) so that they can attempt to resolve the issue on the spot. If the matter cannot be resolved, you should contact us as soon as possible.

If you remain dissatisfied, you must send us written details of your complaint within 28 days of your return from the trip. We will not accept liability for any claims received outside this period.

10. Intellectual Property

All intellectual property rights in the content of our website and marketing materials, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, are owned by us or our content suppliers and are protected by copyright and other intellectual property laws.

You may not reproduce, modify, distribute, or republish materials contained on our website or in our marketing materials without our prior written consent.

11. Amendments to Terms and Conditions

We may revise these Terms and Conditions at any time by updating this page. You are expected to check this page from time to time to take notice of any changes we have made, as they are binding on you.
